O Instituto de Pesos e Medidas do Estado de São Paulo (Ipem-SP) realizou, nesta semana, mais uma etapa da Operação Olhos de Lince de combate às fraudes e irregularidades em bombas medidoras de combustíveis com participação de agentes da Polícia Civil e ANP. Durante a operação, as equipes encontraram irregularidades em estabelecimentos da Saúde e no Moinho Velho.
Das 18 bombas medidoras de combustíveis verificadas, no Auto Posto Boqueirão da Saúde Ltda, localizado à rua do Boqueirão, nº 672, no bairro Saúde, 6 foram reprovadas. As irregularidades encontradas foram violação dos pontos de selagem, do painel. Houve autuação.
No Trevo Serviços Automotivos Ltda, que fica na avenida Padre Arlindo Vieira, nº 160, também na Saúde, houve autuação. Das 12 bombas medidoras de combustíveis verificadas, 12 foram reprovadas. As irregularidades encontradas foram bomba medidora com fraude metrológica, ação de modificação intencional do instrumento (instalação de corpo estranho).
Ainda no bairro, das 26 bombas medidoras verificadas no Auto Posto Festa Ltda, localizado à avenida do Cursino, nº 2.230, todas foram reprovadas. As irregularidades encontradas foram erro de até menos 180ml para cada 20l fornecidos em prejuízo ao consumidor, bomba medidora apresentava fraude metrológica – ação de modificação intencional do instrumento (revestimento do cabo de calibração violado), plano de selagem em desacordo com portaria de Aprovação de Modelo.
Já no Moinho Velho, foi o Triplo X Auto Posto Ltda, localizado à avenida Presidente Tancredo Neves, nº 85, quem recebeu autuação. Das 9 bombas medidoras verificadas, 2 foram reprovadas. As irregularidades encontradas foram erro de até menos 909ml para cada 20l fornecidos em prejuízo ao consumidor, violação dos pontos de selagem (painel) e a bomba medidora apresentava desalinhamento inicial dos algarismos do dispositivo indicador acima do máximo permitido pela legislação metrológica em vigor.
De acordo com informações do Ipem-SP, durante as fiscalizações, se o posto for autuado, tem dez dias para apresentar defesa ao órgão. Segundo a lei federal 9.933/99, as multas podem chegar a R$ 1,5 milhão.
Ainda, conforme o Instituto, quando os fiscais encontram bombas medidoras de combustíveis com indícios de fraude, após apreensão dos componentes eletrônicos e interdição delas, os fiscais identificam qual é a permissionária que presta serviço no estabelecimento, e então, é feito um levantamento nas atividades realizadas por esta permissionária, não só neste posto como também em outros postos.
Caso seja constatada alguma irregularidade em relação a prestação de serviço e ao não atendimento ao Regulamento Técnico Metrológico a que estão sujeitas, é aberto um processo administrativo propondo o descredenciamento da permissionária.
Detectada a fraude é revogada a autorização de manutenção de bombas de combustíveis.
Além de autuar o estabelecimento, o Ipem-SP apura a responsabilidade da oficina encarregada da manutenção das bombas de combustíveis. Caso seja comprovada a participação da oficina na fraude, é revogada sua autorização de manutenção de bombas de combustíveis.
O material coletado é periciado em laboratório do instituto com emissão de laudo direcionado à Secretaria da Fazenda para cassação do cadastro no ICMS e também é enviado ao Ministério Público.
Em 2023, de janeiro a julho, o Ipem-SP fiscalizou 4.321 postos de combustíveis no Estado de São Paulo, verificou 67.924 bombas de combustíveis com 2.983 reprovações. Sendo emitidos 1.123 autos de infração.
