A Prefeitura de São Paulo liberou o passe livre no transporte municipal, das 6h às 20h, em caráter excepcional, no segundo turno das eleições da capital, no domingo (30). A informação foi confirmada nesta segunda-feira (24). Além disso, a Prefeitura vai colocar 2 mil ônibus a mais em circulação. As catracas ficarão travadas, ou seja, a pessoa entra e sai pela frente.
Só no domingo do primeiro turno, em 2 de outubro, mais de 2,5 milhões de passageiros foram transportados pelos ônibus de São Paulo – 370 mil passageiros a mais do que na média para um domingo.
A decisão ocorre após vários políticos e organizações entrarem com ações para pedir a gratuidade no transporte municipal. Na sexta-feira (21), o Ministério Público do estado (MP-SP) se disse favorável às ações.
No documento da ação, o MP alega que existem “claros indícios de que a não concessão da gratuidade do transporte público no segundo turno da eleição tem potencial de alijar pessoas pobres do direito fundamental ao voto”. Além de não existir nenhum “impedimento de ordem jurídica à concessão do benefício”.
“O Ministério Público de São Paulo manifesta-se a favor da concessão da tutela cautelar antecipada para: determinar que a Prefeitura Municipal de São Paulo, com fundamento nos artigos 305 e seguintes do Código de Processo Civil e do artigo 14 da Constituição da República Federativa do Brasil, adote as medidas necessárias para garantir a gratuidade do transporte público urbano coletivo de passageiros do município de São Paulo, no dia 30 de outubro de 2022, data em que ocorrerá o segundo turno das Eleições de 2022”, diz o documento.
Na quarta-feira (19), a maioria dos ministros do Supremo Tribunal Federal aprovou a decisão que autorizou prefeituras e empresas concessionárias possam oferecer, voluntariamente e de forma gratuita, serviço de transporte público no dia 30.
