O Cartório de Registro Civil da região do Ipiranga realizou, entre os dias 21 de maio e 21 de julho, 8 procedimentos de mudança de nome e sexo no registro de nascimento de transgêneros e transexuais. O levantamento foi feito pela Associação dos Registradores de Pessoas Naturais do Estado de São Paulo (Arpen/SP).
Publicado no Diário Oficial de 21 de maio, o Provimento nº 16/2018 da Corregedoria Geral da Justiça do Estado de São Paulo padronizou os procedimentos em unidades do Estado, dando efetividade à decisão do Supremo Tribunal Federal (STF) com relação à Ação Direta de Inconstitucionalidade nº 4.275/DF, publicada em março deste ano. Posteriormente, a Corregedoria Nacional de Justiça publicou, em 29 de junho, o Provimento nº 73, que padronizou o procedimento no resto do País.
Até então, em razão da ausência de ato normativo sobre os procedimentos a serem adotados pelas unidades, cabia a cada titular de cartório realizar ou não o procedimento, assim como a indicação dos documentos a serem solicitados ao cidadão.
Para Karine Famer Rocha Boselli, oficial do 18º Cartório Ipiranga, a iniciativa da Corregedoria Geral da Justiça facilitou a vida do cidadão, já que agora a alteração é feita mais rapidamente. “O Registro Civil está a serviço da população, acompanhando as mudanças constantes da sociedade. Poder solicitar o ato diretamente em cartório garante rapidez e eficiência, além de ser menos burocrático”, afirma a especialista, que também é diretora da Arpen/SP.
Podem realizar a alteração de nome e sexo diretamente nos cartórios pessoas maiores de 18 anos que tenham capacidade de expressar sua vontade de forma inequívoca e livre. Os interessados devem preencher pessoalmente o requerimento de alteração, apresentando os seguintes documentos: RG, CPF, título de eleitor; certidões de casamento e de nascimento dos filhos, se existirem; e comprovante de residência. Também devem ser apresentadas certidões dos distribuidores cíveis e criminais da Justiça Estadual e Federal e da Justiça do Trabalho, sendo que todos são obtidos gratuitamente pela internet nos seguintes endereços:http://www.tjsp.jus.br, www.trf3.jus.br e www.tse.jus.br. Além disso, também são necessárias certidões dos cartórios de protesto para atestar que não há pendência financeira do requerente. Feita a alteração na certidão de nascimento, o cidadão deverá providenciar a mudança do nome e gênero nos demais documentos.
